1. Acceptance of Terms

By accessing or using The Glass Archives ("Platform," "we," "us," or "our") at glassarchives.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. We reserve the right to modify these Terms at any time; continued use of the Platform after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age to create an account or use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. The Platform is intended for users interested in borosilicate glass art, collecting, and the associated community.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your account information current and accurate
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with any third party
  • Not create multiple accounts or impersonate other users

4. User-Generated Content

4.1 Your Content

You retain ownership of content you submit to the Platform ("User Content"). By submitting User Content, you grant The Glass Archives a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and create derivative works of your content solely for the purpose of operating and promoting the Platform.

4.2 Content Standards

You agree not to submit content that:

  • Infringes any third party's intellectual property rights
  • Is false, misleading, or fraudulent (including misrepresenting piece authenticity or provenance)
  • Is defamatory, harassing, threatening, or abusive toward any person
  • Contains illegal content or promotes illegal activity
  • Violates any applicable law or regulation
  • Contains malware, viruses, or other harmful code

4.3 Content Moderation

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful to the Platform or its community. We are not obligated to monitor all content but may do so at our discretion.

5. Marketplace Rules

The Glass Archives provides a marketplace for glass art pieces. Users who list items for sale agree to:

  • Accurately represent all items listed, including condition, provenance, and authenticity
  • Honor agreed-upon transactions with buyers
  • Not engage in price manipulation, shill bidding, or other deceptive practices
  • Comply with all applicable laws regarding the sale of goods

The Glass Archives is a platform facilitating connections between buyers and sellers. We are not a party to any transaction and are not responsible for the quality, safety, legality, or delivery of items listed. All transactions are between users directly.

6. Artist Verification and Claims

Artists may claim their profile page on The Glass Archives by submitting a verification request with supporting documentation. Verified status is granted at our sole discretion. Providing false information in a verification request may result in permanent account termination. Verified artists are responsible for keeping their profile information accurate.

7. Intellectual Property

The Glass Archives name, logo, design, and all Platform content created by us (excluding User Content) are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our proprietary content without express written permission. The artist archive data, including artist profiles and historical information, is compiled by The Glass Archives and may not be scraped, copied, or redistributed in bulk.

8. Prohibited Conduct

You agree not to:

  • Use automated tools, bots, or scrapers to access the Platform without written permission
  • Attempt to gain unauthorized access to any part of the Platform or its infrastructure
  • Interfere with or disrupt the Platform's operation or servers
  • Circumvent any rate limiting, security measures, or access controls
  • Use the Platform for spam, unsolicited commercial messages, or phishing
  • Harass, stalk, or threaten other users
  • Engage in any activity that could damage the reputation of The Glass Archives or the glass art community

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Market data, price estimates, and valuations displayed on the Platform are for informational purposes only and are not professional appraisals. Do not rely on Platform data for insurance, legal, or financial decisions without consulting a qualified professional.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GLASS ARCHIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through your account settings or by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.
