DMCA Copyright Policy

Overview

The Glass Archives respects the intellectual property rights of artists, photographers, and creators. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid copyright infringement notices. If you believe that content on our Platform infringes your copyright, please follow the procedure below.

1. Reporting Copyright Infringement

To submit a DMCA takedown notice, send a written communication to our designated DMCA agent at [email protected] that includes all of the following:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or if multiple works are covered, a representative list.
  2. Identification of the infringing material: A description of the material you claim is infringing and information reasonably sufficient to locate it on the Platform (e.g., the URL of the specific page).
  3. Your contact information: Your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Signature: Your physical or electronic signature.

2. Our Response to Takedown Notices

Upon receipt of a valid DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing content. We will notify the user who posted the content that it has been removed and provide them with a copy of the takedown notice (with your personal contact information redacted where possible).

3. Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification to [email protected] that includes:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your name, address, telephone number, and email address
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which The Glass Archives may be found

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant files a court action.

4. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We reserve the right to terminate any user's account at our sole discretion if we determine that the user has repeatedly infringed the copyrights of others.

5. Note on Artist Photographs

The Glass Archives maintains an archive of borosilicate glass artists. Artist profile photographs are sourced from publicly available materials or submitted by artists themselves. If you are an artist and wish to update or remove your profile photograph, please contact us at [email protected] or claim your artist page to manage your profile directly.

6. Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
